When a person dies intestate (meaning without a will), their estate can’t be managed right away because there’s no officially appointed executor. In these cases, the next of kin or a close family member has to apply for what’s called a Letter of Administration. This legal document gives the applicant the authority to handle the deceased’s assets — such as closing bank accounts, selling property, and paying off debts.

The process usually starts by filing an application with the probate or surrogate court in your area. You’ll need to provide documents like the death certificate, proof of relationship, and sometimes a list of the estate’s assets and liabilities. If there are multiple family members eligible to apply, the court might ask for written consent from the others.

Once the letter is granted, the appointed administrator (similar to an executor) has the legal duty to manage the estate properly, which includes paying any outstanding debts, filing taxes, and distributing what’s left according to the laws of intestacy. These laws vary by region, but generally, the spouse, children, or closest relatives inherit in a specific order set by law.

It’s worth noting that without a will, the process can take longer and may lead to disputes among family members. That’s why it’s often recommended to get legal advice or at least consult your local probate office for guidance.

Has anyone here gone through applying for a Letter of Administration before? How long did the process take, and what challenges did you face? Your experiences could really help others who are just starting this journey.

Looking forward to hearing your thoughts!
